Students who believe that they have been discriminated against on the basis of their handicapping condition have the right to appeal to the school’s 504 Coordinator. If the student is not satisfied with the decision of the school’s 504 Coordinator, he/she may appeal to the district 504 coordinator, and, if still not satisfied may appeal to the superintendent and then to the board. The superintendent will schedule appeals to the board.
Due Process
The board and its administrators will treat all students with fairness. Before school authorities administer disciplinary measures, they will make reasonable inquiry to determine the truth of what happened. The nature of the inquiry will vary with the seriousness of the offense and the consequences. The board directs school authorities to adhere to due process requirements when making decisions directly affecting students' protected rights under federal and state law. Such requirements may include the following:
1. sufficient notice of charges and of hearing rights,
2. the opportunity to be heard,
3. hearing before an impartial body (i.e. not subject to the same person
for both prosecution and decision),
4. punishment as prescribed by the general assembly, state board of
education and/or board policy with the right to judicial review If a student feels that teachers, principals, superintendents or any agents of the board have injured his/her rights, he/she may appeal the action in accordance with the district grievance procedure Policy JEC.
Discrimination
Discrimination of all persons is prohibited with regard to employment and any other program or activity on the basis of race, religion, sex, national origin, age, color, immigrant status, English speaking status or disabling condition in District Five Schools of Spartanburg County as required by Title IX of the Educational Amendments Act of 1972, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, and the Civil Rights Act of 1964 as amended.
