                stalking, domestic violence, dating violence, sex discrimination and other inappropriate sexual conduct as defined under the Sexual Misconduct Policy (“Policy”). Sexual misconduct is a form of sex discrimination and will not be tolerated.

Texas Education Code § 51.252(“SB 212”) requires all UTEP employees who in the course and scope of employment witness or receive information re- garding an incident reasonably believed to consti- tute sexual harassment, sexual assault, dating vio- lence, or stalking, and which is alleged to have been committed by or against a person who is a UTEP student or employee at the time of the incident,
must promptly report the incident to UTEP’s Title IX Coordinator or Title IX Deputy Coordinator. Im- portantly, the report, must include all information concerning the incident known to the reporting person that is relevant to the investigation. An em- ployee who fails to report, or with an intent to harm or deceive knowingly makes a report that is false, may also be subject to a criminal offense (Class
A or B misdemeanor). UTEP will also terminate the employee whom the institution determines in accordance with institutional disciplinary procedure to have committed the offense of failing to report or making a false report. Lastly, a Responsible Employee—defined to include all administrators, faculty, staff, resident life directors and advisors, and graduate teaching assistants—who receives a report of sexual misconduct must promptly report the incident to the Title IX Coordinator or a Deputy Title IX Coordinator.
