The University of Texas at El Paso is committed to maintaining a learning and working environ- ment that is free from discrimination based on sex in accordance with Title IX of the Higher Education Amendments of 1972 (Title IX), Title VII of the Civil Rights Act of 1964 (Title VII) and the Campus Sexual Violence Elimination Act (SaVE Act). Sexual misconduct includes sexual harassment, sexual violence, sexual assault, stalking, domestic violence, dating violence, sex discrimination and other inappropriate sexual conduct as defined under the Sexual Misconduct Policy (“Policy”). Sexual misconduct is a form of sex discrimination and will not be tolerated.
The Policy protects individuals from retaliation for filing a complaint or report, participating in or not in the Grievance Process, and for opposing any unlawful activity. For more information about the University’s Policy, please visit: https://www.utep.edu/titleix/

Texas Education Code § 51.252(“SB 212”) requires all UTEP employees who in the course and scope of employment witness or receive information regarding an incident reasonably believed to constitute sexual harassment, sexual assault, dating violence, or stalking, and which is alleged to have been committed by or against a person who is a UTEP student or employee at the time of the incident, must promptly report the incident to UTEP’s Title IX Coordinator or Deputy Title
IX Coordinator. Importantly, the report, must include all information concerning the incident known to the reporting person that is relevant
to the investigation. An employee who know- ingly fails to report, or with an intent to harm or deceive knowingly makes a report that is false, may also be subject to a criminal offense (Class A or B misdemeanor). UTEP will also terminate the employee whom the institution determines in ac- cordance with institutional disciplinary procedure to have committed the offense of failing to report or making a false report. Lastly, a Responsible Employee—defined to include all administrators, faculty, staff, resident life directors and advisors, and graduate teaching assistants—who receives a report of sexual misconduct must promptly report the incident to the Title IX Coordinator or a Deputy Title IX Coordinator.
