In all circumstances, the student must present their concern in writing. The personnel involved in hearing
the case will provide a written response with 5 days of the interview that occurs with the student in Step
2, 3, and 4. Other appeal procedures may supersede the process above. These processes include, but
are not limited to, the Student Conduct Appeal Process, Student Academic Progress Reviews, and
reviews conducted by the Admissions and Academic Standards Committee. The Student Services Office
will direct you to the correct appeal body for your situation. If no appeal body exists, proceed with the
steps listed above.
Title IX of Education Amendments of 1972
Title IX and its implementing regulation, at 34 C.F.R. § 106.31 (a), provide that no person shall on the
basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to
discrimination under any academic, extracurricular, research, occupational training, or other education
program or activity operated by the university.
Sexual harassment is a form of sex discrimination prohibited by Title IX. Sexual harassment is
unwelcome conduct of a sexual nature. Sexual harassment can include unwelcome sexual advances,
requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature, including
rape, sexual assault, sexual battery and sexual coercion or other sexual misconduct.
Sexual harassment of a student can deny or limit, on the basis of sex, the student's ability to participate
in or to receive benefits, services, or opportunities in the school's program.
Any student, faculty or staff member with questions or concerns about sex discrimination or sexual
harassment or who believes that he or she has been the victim of sex discrimination or sexual
harassment may contact the Title IX Coordinator for assistance. The Title IX Coordinator is available to
discuss options, explain college policies and procedures, and provide education on relevant issues.
Title IX complaints involving student complainants and student respondents will be referred to the Title IX
Coordinator for investigation and shall be subject to the student code of conduct.

FOR INSTRUCTIONAL PETITIONS, PLEASE FOLLOW THESE PROCEDURES:
To appeal any decision, action, or inaction pertaining to instructional issues such as concerns about
an instructor, change of grade, course substitutions, academic sanctions, or other instructional
matters, the student should:
STEP 1
Discuss the issue in question with the original decision maker, e.g., an instructor. If the problem is not
resolved to the satisfaction of the student at this level, the student should then determine the immediate
College supervisor of the employee or faculty member making and/or enforcing the questioned decision and
schedule an appointment with that person. This supervisor may be a director or a division chair. In this
informal meeting, the student will be expected to verbally explain the situation, indicate concerns, and
suggest possible solutions.
If not satisfied with the results of this meeting, the student should seek further review as follows:

Exceptions to late withdrawal from college (all courses), reinstatement to college following
disqualification or suspension, and transfer and/or substitution of course credits that NIC transcript
evaluators have not accepted as satisfying graduation requirements may be requested through the
